1.0 General Background

 

James
Madison once wrote “if men were angels,
no government would be necessary.1
This statement by James Madison cemented the notion made by Lord Action that
“absolute power corrupts absolutely”2
Notwithstanding, power must exist and government is universally acceptable because
man cannot withhold himself except within a civilised and well-ordered society.3

 

The Gambian constitution recognises The Gambia
as a democratic state4.

Democracy as defined by Abraham Lincoln is “A
government of the people, by the people, for the people.”5
Section 1(2) of the constitution is no better understood in simple language
than how Abraham Lincoln defined democracy. It rests the sovereignty of The
Gambia in the people.6
